In an article for the Daily Journal, partner Abimael “AJ” Bastida explains the importance of oral argument and its impact inside and outside the courtroom. Although judges and lawyers may prefer legal briefs and written arguments, Bastida argues that oral argument is a practice that should be preserved.
Oral argument, which is typically a public proceeding, contributes to promoting transparency and accountability in the judicial system, while also advancing the quality of lawyers and encouraging camaraderie among those in the legal field.
“Witnessing lawyers appearing in open court for their clients shows the judicial system at work. It is a vital and revered element of our legal framework,” states Bastida. “Rather than be discounted, oral argument should be actively promoted and encouraged by judges and lawyers alike.”
