In his byline article for the Daily Journal’s annual “New Laws” supplement, Michael Warren looks at Assembly Bill 2257, the bill designed to clean up the controversial AB 5. Michael reviews the key differences between the two bills and the various industry exemptions – 53 in total – listed in the bill, including translators, performance artists, and home inspectors, among others.
Michael also looks at the retroactivity question of AB 2257, which has become a hot issue on the worker classification circuit. He explains, “While the subdivision that codifies the ABC test has no express retroactivity language, the subdivision concerning the exceptions to the ABC test does have such language.”
